Notice of Intellectual Property (IP) Infringement for crossborder services

Mercari, Inc. (“Mercari”) respects copyrights, trademark rights, patent rights, design rights, and other intellectual property rights.
If you discover content on our service that you believe infringes your rights, please contact us using the method below.

How to Submit a Notice

Please submit your notice of infringement to our designated agent at the following email address:

Required Information for a Notice

To ensure your request is processed promptly and accurately, please include all the information listed below. We may be unable to take action if the information provided is incomplete.

1. Information about the rights holder:

Information demonstrating that you are the rights holder or an authorized representative.

  • Name (if a representative, include both the rights holder and the representative)
  • Address

2. Identification of the relevant content:

A description of where the infringing material appears on Mercari, with enough detail to help us locate it, or the specific URL of the listing or content suspected of infringing rights.

3. Description of the rights:

Please provide information regarding the intellectual property rights claimed to be infringed.

  • Trademarks, Patents, Design Rights, Plant Breeder’s Rights: Provide the Registration Number and the country of registration.
  • Copyrights: A clear description of the copyrighted work that you believe has been infringed. You may include the Registration Number, if the copyrighted work is registered.
  • Publicity Rights: Provide a description to identify the rights that you believe has been infringed.

4. Contact information:

  • Name of contact person or company name
  • Address
  • Phone number
  • Email address

5. Statement:

When asserting a claim of U.S. copyright infringement, please include the following statements

  • “I have a good faith belief that the use of the content identified above is not authorized by the rights holder, its agent, or the law.”
  • “The information contained in this notice is accurate.”
  • “Under penalty of perjury, I declare that I am the owner of the copyright, or am authorized to act on behalf of the owner of an exclusive right in the copyrighted work.”

6. Signature: When asserting a claim of U.S. copyright infringement, please include:

  • a physical or electronic signature of the person authorized to act on behalf of the copyright owner

Counter-Notice

The provider of the content that has been removed may submit a counter-notice in accordance with applicable laws. For details on how to submit a counter-notice, please refer to the notification email sent to the affected party.

Notes

  • Incomplete Notices: Notices lacking mandatory information may not be processed.
  • False Claims: Claims made for improper purposes or containing false information may result in legal liability, including claims for damages.
